I would strongly advise you to do tax planning with a CPA, or tax attorney who can go over in detail your particular situation.  Trying to do tax planning on a discussion forum is not the best vehicle for information.<br />

There are just too many variables that can change the ultimate answer to your situation.<br />
<br />
Question 1: Yes there can be tax consequences.<br />
<br />
Question 2: If title remains with the corporation and a new loan is negotiated, then there is not normally a tax consequence.  It is where title changes hands between a corporation and a shareholder that there is an issue.<br />
<br />
You need to see my earlier post in the thread that you started below.  In my response to Warren, I made reference to Internal Revenue Code section 311.  You need to look at that code section and see if that applies to your particular situation.<br />
<br />
Again, I would caution you to seek professional help in working through your tax issues.  You need the give-and-take of talking with someone who is knowledgeable, because it can make a world of difference in the final answer!!!]]></content:encoded>

It depends where the fence was in relation to the property line.<br />
<br />
If it was on your property, they should not have taken it down.  If it was on their property, you really have no say in the matter.<br />
<br />
You need to immediately to put up a temp fence around your pool to avoid a catastrophic accident with huge liability exposure for you.<br />
<br />
